Accessing information about me (Health Records and Non-Health Information)
The Data Protection Act 1998 gives you a statutory right of access to your health records or other information the Trust may hold. The easiest way to make a request to access information held by this Trust is to download one of the Subject Access Request Forms below. Application forms and identification can then be sent either by email to firstname.lastname@example.org or by post to Compliance Team, Norfolk & Suffolk NHS Foundation Trust, Hellesdon Hospital, Kestrel House, Drayton High Road, Norwich, Norfolk, NR6 5BE.

Accessing information about a deceased person
Where necessary a request can be made to access the health records of the deceased. This is under the Access to Health Records Act 1990. It is the policy of the Trust that health records are normally closed to the general public for 100 years following the death of a service user. However, the Access to Health Records Act provides certain individuals with a right of access to the heath records of the deceased individual. These are defined by the Act as “the patient’s personal representative and any person who may have a claim arising out of the individual’s death”. A personal representative is the executor or administrator of the deceased person’s estate. Proof of your authority to access the record (such as a copy of the will confirming you are executor, or other details of your claim) will be required.

When returning your application form please provide evidence of your identity (or the service users), along with proof of your address. Guidance can be found if you click here regarding which forms of identification and proof of address can be accepted.
Under the Data Protection Act and Access to Health Records Ac the Trust can make a charge of up to £50. However, this Trust does not make a charge for any requests made under these legislations.
Once we have received your valid request a search will be carried out to locate any health records or information that the Trust holds. The Trust will then collate all records based on the scope of your request and supply these in PDF format to you via email.*
The Trust has 40 days to provide the information.
